Loyalty Card Program -
General Terms and Conditions (hereinafter: GTC)
Pertaining to the use of the Douglas loyalty card offered by Parfümerie Douglas Korlátolt Felelősségű Társaság (registered seat: 1052 Budapest, Váci u. 11/A; tax number: 12508574-2-41; hereinafter: Parfümerie Douglas Kft.).
1. Application for a loyalty card
Any natural person over the age of 14 may apply for a loyalty card. The acceptance of the present GTC is a condition of application. Applicants must provide the data marked with an asterisk (*) on the Douglas loyalty card “Data form”, in the absence of these data Parfümerie Douglas Kft. is not required to issue the loyalty card. In case Parfümerie Douglas Kft. accepts the application, a loyalty card will be issued to the applicant, which can be used, in accordance with Section 2 of the GTC, for collecting loyalty points in case of making purchases in the stores of Parfümerie Douglas Kft. and/or in the webshop available at www.douglas.hu (hereinafter: Douglas webshop), as well as for receiving discounts after the collection of a specific number of loyalty points. In order to have the loyalty points credited, it is necessary to present the card to the sales associate in the store at the time of making a purchase. A loyalty card may be requested in any store of Parfümerie Douglas Kft., free of charge.
2. The use of the loyalty card
The holder of the loyalty card may participate in the loyalty program of Douglas by using his/her card. Cardholders are entitled to obtain 1 loyalty point after each 300 HUF worth of purchase made in the stores of Parfümerie Douglas Kft. and/or in Douglas webshop. After each 100 loyalty points collected, we issue a loyalty voucher in the amount of 1,500 HUF (hereinafter: loyalty voucher), which may be used in the course of any subsequent purchase in a freely-chosen Douglas perfumery within 6 months after the voucher was issued. Parfümerie Douglas Kft. expressly calls the cardholders attention that loyalty vouchers can not be used in the course of any purchase in Douglas webshop. In any given month, a maximum of 30 loyalty vouchers may be issued per cardholder; in case the cardholder has additional loyalty points that would entitle him/her to more loyalty vouchers, these vouchers will be issued in the following month. At the first application for a loyalty card, Parfümerie Douglas Kft. will automatically credit 50 loyalty points to the cardholder’s account. However, the cardholder will not be entitled to the crediting of the 50 loyalty points if a card is issued because the previous card was damaged, destroyed or lost. Loyalty points are valid for 24 months from the date when they were credited. If within 24 months from the date when loyalty points were credited a purchase resulting in the crediting of points is not made, or within the above mentioned period a loyalty voucher may not be issued on the basis of the points collected by the cardholder, the unused points will be automatically deleted. Loyalty vouchers are issued once a month; the notification message about issuance will be sent primarily by e-mail (to the e-mail address provided on the data form) and, if the cardholder provided his/her mobile phone number, also in a text message. In order to receive notifications by text message, the cardholder must provide a mobile phone number that belongs to a Hungarian mobile phone operator. For crediting of loyalty points and for use of loyalty vouchers it is necessary for the cardholder to present his/her loyalty card to the sales associate prior to paying for the purchase. Parfümerie Douglas Kft. does not and may not check the personal identity of the cardholder when a loyalty voucher is used, and therefore, any liability for the use of the loyalty card by an unauthorized person is hereby excluded. If loyalty card has been broken or otherwise damaged, Parfümerie Douglas Kft. may refuse to credit loyalty points or accept a loyalty voucher. Loyalty vouchers may not be used for purchasing gift cards. Loyalty vouchers are not redeemable for cash; if full amount of a loyalty voucher is not used in the course of the purchase, the cardholder is not entitled to receive the difference in cash or in any other way. In case of making a purchase as a cardholder in a Douglas perfumery abroad or using Douglas loyalty card issued in a foreign country, no loyalty points are credited, and the cardholder is not entitled to use any further discounts either. Cardholder shall not be entitled to credit any loyalty points after a purchase in Douglas webshop, if the cardholder withdraws from the purchase or in that case if the cardholder fails to collect the ordered product(s). In case of a technical problem preventing the crediting of the loyalty points or the use of the loyalty voucher, Parfümerie Douglas Kft. will ensure that the problem is corrected within a reasonable time.
3. The procedure in case of the loss, damaging or destruction of the loyalty card
In case of the loss, damaging or destruction of the loyalty card, the cardholder may request a new loyalty card at any time. Parfümerie Douglas Kft. provides the new loyalty card for the cardholder free of charge. In such a case Parfümerie Douglas Kft. will invalidate the earlier card. A new loyalty card may be requested in the stores of Parfümerie Douglas Kft. only in person by completing the data form.
4. The term of the contract, termination
The contract for the use of the loyalty card is concluded between the parties for an indefinite term. The cardholder may terminate the contract at any time with immediate effect, without providing reasons, in writing (address: Parfümerie Douglas Kft. 1052 Budapest, Váci u. 11/a., e-mail address: card@douglas.hu). Parfümerie Douglas Kft. may terminate the contract at any time, without providing reasons for the termination. In individual cases, Parfümerie Douglas Kft. will notify the cardholders of the fact of the termination, in writing. If Parfümerie Douglas Kft. ends the loyalty program and terminates the contract concluded between the parties for this reason, notice of termination and ending of the loyalty program will be given 30 days in advance on the www.douglas.hu website, as well as by way of a written notice posted in the stores of Parfümerie Douglas Kft., in a place well-visible to customers. The date of end of the loyalty program is the date identified in the notification. After posting of the notification, Parfümerie Douglas Kft. will not issue new loyalty cards, and it will not be possible to apply for new loyalty cards. After termination notice of the contract governing the use of the loyalty card is given by either party with immediate effect or the ending of the loyalty program, the card may not be used in any form, no loyalty points will be credited for the cardholders, no loyalty vouchers will be issued, and loyalty card will not entitle its holder for using any further discounts.
5. Amendments to the GTC
Parfümerie Douglas Kft. is entitled to amend the present GTC unilaterally, for the purpose of extending the services provided by it, making such services more efficient, as well as introducing new services. Parfümerie Douglas Kft. will inform cardholders about amendment of the GTC on the www.douglas.hu website and also by way of a notice posted in the stores of Parfümerie Douglas Kft., in a place well-visible to customers, at least 30 days before such amendments become effective. The notice will include an exact reference to the amended provisions of the GTC, the date when such amendments enter into effect, as well as information on the availability of the amended GTC and on the conditions of the termination with immediate effect available to cardholders. In case the cardholder does not wish to accept the amendments to the GTC, he/ she may terminate the contract with immediate effect within 30 days before the amendments enter into effect by a written declaration to the postal address Parfümerie Douglas Kft., 1052 Budapest, Váci u. 11/a. or via electronic mail to card@douglas.hu). If cardholder does not terminate the contract within 30 days, the amendments of the GTC shall be considered as accepted by the cardholder.
6. The delivery of offers, discounts and other marketing-purpose information
If the cardholder expressly consented to the delivery of offers, discounts and other, marketing-purpose information either when completing the data form or when updating his/her data, electronic messages will be sent to the e-mail address and/or the mobile phone number last provided by the cardholder for Parfümerie Douglas Kft.; postal mail will always be sent to the postal address last provided for Parfümerie Douglas Kft. If cardholder does not provide a Hungarian address, Parfümerie Douglas Kft. will not be required to send offers, discounts or other information to the foreign address by postal mail. The above requirement is also applicable to mobile phone numbers; in case the cardholder requests notification by way of text messages or phone calls, the mobile phone to be provided must be one belonging to a Hungarian mobile phone operator. The cardholder may give notice of any changes in his/her address by way of completing the form available in the stores. Parfümerie Douglas Kft. will not be liable for any damage arising from the failure to give notice of the change in the cardholder’s address. Parfümerie Douglas Kft. shall not obliged to replace any postal consignment that is damaged, lost, destroyed or undelivered. By accepting the GTC and completing the relevant fields of the data form, the applicant expressly consents to Parfümerie Douglas Kft. contacting him/her, by way of postal mail and electronically, also beyond the loyalty programme, in connection with offers within the scope of activities of Parfümerie Douglas Kft. and/or products distributed by Parfümerie Douglas Kft. If the cardholder consented by completing the data form, Parfümerie Douglas Kft. will inform the cardholder of the seasonal, one-time discounts related to the loyalty programme on its website at www.douglas.hu, in the publication titled “Douglas Magazin”, as well as by way of the information materials available in its stores. Occasionally, Parfümerie Douglas Kft. will also inform the cardholder of the discounts by way of postal mail and electronically, but the main channels of providing information will be the website, the magazine and the information materials in the stores, as described above.
7. Data protection notice related to the Douglas loyalty card program
Parfümerie Douglas Kft. informs applicants that participation in the loyalty card program, as well as the provision of data in the interest of such participation are voluntary. By way of applying for a loyalty card, the cardholder gives his/her express consent to Parfümerie Douglas Kft. processing his/her data provided in the course of the application in the interest of the use of the loyalty card, improving the standard of the services provided, as well as the introduction of new services. The controller of the data provided by the applicant is Parfümerie Douglas Kft. In the framework of the loyalty program, in the interest of the crediting of the loyalty points, as well as the issuance and the management of the loyalty vouchers, the applicant is required to provide at least the following personal data when applying for or renewing the loyalty card: name (family and given names), address, e-mail address, mobile phone number, place and date of birth. Parfümerie Douglas Kft. informs the applicants that, in the absence of the provision of the above data, the applicant will not be entitled to receive a loyalty card and/or participate in the loyalty programme. On the data form, the applicant may also indicate his/her sex; however, the provision of this information is not a condition of the acceptance of the application and the issuance of the card. If, by accepting the GTC and completing the relevant fields of the data form, the cardholder expressly consented to Parfümerie Douglas Kft. contacting him/her in connection with offers within the scope of activities of Parfümerie Douglas Kft. and/or products distributed by the company the purpose of the data processing is the delivery of offers to the cardholder. By applying for a loyalty card, the cardholder expressly acknowledges and accepts that Parfümerie Douglas Kft. may process the required data during the validity of the loyalty card or for a period of 10 years after the last purchase made by the cardholder, whichever comes later, and that on the basis of the data provided, Parfümerie Douglas Kft. may process and keep records of the purchases of the cardholder (in the interest of the crediting of the loyalty points and the validation of the loyalty vouchers). On the basis of the data provided, if the applicant expressly consented to this in the course of completing the data form, the processors used by the controller will send the newsletters related to the loyalty card by way of text messages, e-mail or postal mail; in the interest of the above, the mobile phone number, e-mail address, as well as name and address provided by the cardholder will be transmitted to such processors. No other personal data will be disclosed to third parties, except when required by a relevant provision of law or a final decision of a court or authority. By completing and signing the data form, based on being duly informed, the cardholder voluntarily, clearly and expressly consents to Parfümerie Douglas Kft. using the data provided by him/her, as well as the data related to his/her transaction history generated in the course of the purchases made (date and place of purchases, articles, value), for the purposes of direct marketing, information and market research. The cardholder may, at any time, request from the controller access to his/her personal data processed by the controller, the rectification or erasure of such data, or the restriction of the processing, and may also object to the processing of such data, by way of electronic mail (e-mail address: card@douglas.hu) or postal mail (postal address: Parfümerie Douglas Kft., 1052 Budapest, Váci utca 11/A). In addition, the cardholder is also entitled to revoke his/her consent at any time, in part or in whole, to the use of the data provided by him/her, as well as the data related to his/her transaction history for the purposes of direct marketing, information and market research. The revocation may be sent electronically (e-mail address: card@douglas.hu) or by postal mail (postal address: Parfümerie Douglas Kft., 1052 Budapest, Váci utca 11/A). Result of the revocation of the whole consent to data processing will be that Parfümerie Douglas Kft. is unable to provide the use of the loyalty card for its intended purpose, and therefore, the revocation of the consent will constitute the termination of the loyalty card contract. The controller calls the attention of the cardholders to the fact that the revocation of the consent to the processing of the data will not affect the lawfulness of any previous data processing. Cardholders may, in case of a breach of the rules applicable to the processing of their personal data, submit a complaint to the data protection officer of Parfümerie Douglas Kft. (postal address: 1539 Budapest, Pf.: 602/3., e-mail address: adatvedelem@douglas.hu) or to the National Authority for Data Protection and Freedom of Information (postal address: 1125 Budapest, Szilágyi Erzsébet fasor 22/c., e-mail address: ugyfelszolgalat@naih.hu). Further, the cardholder also has the right, in case of the breach of his/her rights related to the processing of personal data, to initiate proceedings for legal remedy at the competent court of jurisdiction according to the registered seat of Parfümerie Douglas Kft. or the permanent or temporary address of the data subject. 8. Miscellaneous provisions
Any issue not regulated by the present GTC is governed by Act V of 2013 on the Civil Code of Hungary and other applicable provisions of law.
